What Data Do We Process?<\/h6>\n\n\n\n<p class=\"wp-block-paragraph\">The categories of data processed depend on which service an individual uses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may process, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>name, personal identification code and date of birth;<\/li>\n\n\n\n<li>telephone number, email address and other contact details;<\/li>\n\n\n\n<li>appointment booking and service-related information;<\/li>\n\n\n\n<li>information concerning health status and medical history;<\/li>\n\n\n\n<li>diagnoses, symptoms and treatment-related information;<\/li>\n\n\n\n<li>information relating to medications and prescriptions;<\/li>\n\n\n\n<li>results of examinations, tests and assessments;<\/li>\n\n\n\n<li>information disclosed by the patient to a specialist during an appointment;<\/li>\n\n\n\n<li>where necessary, family, social, employment or developmental history, where this is necessary to assess the patient&#8217;s condition or provide the service;<\/li>\n\n\n\n<li>referrals and other healthcare documentation;<\/li>\n\n\n\n<li>information necessary for billing;<\/li>\n\n\n\n<li>information relating to patient enquiries, feedback and complaints;<\/li>\n\n\n\n<li>where necessary, information concerning the patient&#8217;s representative, family member or contact person.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Health data constitute a special category of personal data, and we apply enhanced confidentiality and security requirements to their processing.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">3. Why Do We Process Personal Data?<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Arranging Appointments<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We process the patient&#8217;s name, contact details and booking information to register, change or cancel appointments and to send necessary information and reminders relating to appointments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Provision of Healthcare Services<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SELUS Kliinik processes patients&#8217; personal and health data to assess their health status, diagnose conditions, prescribe and monitor treatment, prescribe medication, and document the provision of healthcare services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The processing of health data necessary for the provision of healthcare services is generally not based on the patient&#8217;s separate consent to data processing, but on the necessity of providing healthcare services and the legal obligations imposed on SELUS Kliinik by applicable legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Psychological and Therapy Services<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During appointments with a psychologist, therapist or other specialist, we process information necessary to provide the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the specific service, the legal basis for processing may be the provision of healthcare services, performance of a contract with the patient, or another legal basis provided by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Diagnostics and Assessment<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When conducting an assessment for ADHD, autism spectrum disorder or another condition, we may process, among other things, the patient&#8217;s medical and developmental history, questionnaire and test results, previous treatment records, and other information necessary for the assessment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We collect only data that are necessary to conduct the specific assessment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Billing and Accounting<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We process personal and payment information necessary for billing, checking payments, and fulfilling accounting and tax obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Compliance with Legal Obligations and Protection of Rights<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where necessary, we may also process data to comply with legal obligations, resolve patient enquiries or complaints, handle patient safety incidents, and prepare, pursue or defend legal claims.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">4. Where Do We Obtain Data From?<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">We obtain most personal data directly from the patient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When providing healthcare services, we may also obtain necessary information about the patient from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the national health information system;<\/li>\n\n\n\n<li>the Prescription Centre;<\/li>\n\n\n\n<li>other healthcare providers;<\/li>\n\n\n\n<li>Tervisekassa (the Estonian Health Insurance Fund);<\/li>\n\n\n\n<li>the patient&#8217;s legal representative;<\/li>\n\n\n\n<li>the patient&#8217;s family member with the patient&#8217;s consent;<\/li>\n\n\n\n<li>an insurance provider, where the patient uses an insurance service;<\/li>\n\n\n\n<li>other sources permitted by law.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Healthcare professionals access patient data only to the extent necessary to provide services to the particular patient.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">5. Use of the eKliinik System<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">SELUS Kliinik uses the <strong>eKliinik information system<\/strong>, provided by <strong>Connected O\u00dc<\/strong>, for the organisation and documentation of healthcare services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">eKliinik may be used to process, among other things:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the patient&#8217;s personal and contact details;<\/li>\n\n\n\n<li>appointment information;<\/li>\n\n\n\n<li>information relating to the provision of healthcare services;<\/li>\n\n\n\n<li>healthcare documentation;<\/li>\n\n\n\n<li>information concerning diagnoses and treatment plans;<\/li>\n\n\n\n<li>information necessary for billing.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Connected O\u00dc processes personal data through eKliinik on behalf of SELUS Kliinik in accordance with the agreement between the parties and applicable data protection requirements.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">6. National Health Information System and Prescription Centre<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">As a healthcare provider, SELUS Kliinik is required to document the provision of healthcare services and submit data prescribed by law to the national health information system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When providing healthcare services, SELUS Kliinik healthcare professionals may access a patient&#8217;s previous health data in the national health information system to the extent necessary to provide healthcare services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Prescription Centre is used when prescribing medication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Patients can access their health data recorded in the national health information system, as well as available logs concerning access to and use of their data, through the <strong>Terviseportaal (Health Portal)<\/strong>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">7. Who May We Disclose Data To?<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">SELUS Kliinik <strong>does not sell patients&#8217; personal data or health data<\/strong> and does not provide them to third parties for their own marketing purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We disclose data only where this is necessary for the provision of services, required by law, or where another valid legal basis exists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the circumstances, recipients of data or data processors may include:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Connected O\u00dc \/ eKliinik<\/strong> \u2013 as the provider of the patient management and healthcare documentation information system;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Merit Tarkvara AS \/ Merit<\/strong> \u2013 when processing data related to accounting and billing;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>PZU<\/strong> \u2013 as SELUS Kliinik&#8217;s insurer, where disclosure is necessary for handling an insurance claim or fulfilling SELUS Kliinik&#8217;s rights and obligations;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Tervisekassa, the national health information system and the Prescription Centre<\/strong> \u2013 in cases prescribed by law;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Other healthcare providers<\/strong> \u2013 where disclosure is necessary to organise the patient&#8217;s treatment and there is a legal basis for doing so;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>IT, communications, server and cloud service providers<\/strong> \u2013 solely for providing services necessary for SELUS Kliinik and in accordance with data protection requirements;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Accountants, auditors and legal advisers<\/strong> \u2013 to the extent necessary for providing their professional services;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>State authorities and other competent authorities<\/strong> \u2013 where SELUS Kliinik has a legal obligation to disclose data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Service providers are granted access only to the data and only to the extent necessary for providing their services.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">8. Insurance and PZU<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">SELUS Kliinik has professional liability insurance coverage through PZU in connection with the provision of healthcare services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of an insurance claim, it may be necessary to provide PZU with information relating to the patient for the purposes of assessing and handling the claim, including health data where necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such data are disclosed only on the basis of the specific circumstances and to the extent necessary to process the insurance claim or handle legal claims.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">9. Confidentiality and Data Security<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Information relating to mental health is particularly sensitive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SELUS Kliinik implements appropriate organisational and technical security measures to protect personal data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Access to patient data is limited to SELUS Kliinik employees and specialists who need such access to perform their professional duties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All employees and partners who have access to patient data are subject to confidentiality obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">User access rights are applied in information systems, and logging is used to ensure the traceability of data processing.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">10. How Long Do We Retain Data?<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">We retain personal data only for as long as necessary to fulfil the purposes for which they were processed or as required by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Healthcare service records<\/strong> \u2013 records evidencing the provision of outpatient and inpatient healthcare services are generally retained for <strong>30 years from confirmation of the data concerning the service provided to the patient<\/strong>, unless legislation establishes a different retention period for a particular document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Information system logs<\/strong> \u2013 logs of data processing in healthcare provider information systems are retained for the period prescribed by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Accounting data<\/strong> \u2013 retained for the period prescribed by legislation governing accounting and taxation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Correspondence and enquiries<\/strong> \u2013 retained according to the content and purpose of the enquiry, taking into account applicable limitation periods for potential legal claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where processing is based on consent, we retain the data until the relevant purpose ends or consent is withdrawn, unless there is another legal basis for continued retention.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">11. Email, Telephone and Appointment Reminders<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">We use patients&#8217; contact details to communicate with them regarding appointments, treatment or other services they use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may send, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>appointment confirmations and reminders;<\/li>\n\n\n\n<li>information about changes to or cancellation of appointments;<\/li>\n\n\n\n<li>invoices and payment-related information;<\/li>\n\n\n\n<li>other information necessary to arrange the patient&#8217;s service or treatment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These communications are not direct marketing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ordinary email may not be the most secure method for transmitting sensitive health data. We therefore recommend that health information be sent by email only to the extent necessary to address the specific matter.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">12. Website and Cookies<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">The SELUS Kliinik website uses cookies that are necessary for the operation of the website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If analytical, marketing or other non-essential cookies are used on the website, they are used in accordance with the cookie choices made by the visitor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where required, we obtain the visitor&#8217;s consent before using non-essential cookies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Visitors can change their cookie preferences through the cookie management solution available on the website or through their browser settings.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">13. Marketing<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">SELUS Kliinik does not use patients&#8217; health data for direct marketing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an individual has provided separate consent to receive SELUS Kliinik newsletters or marketing communications, we may use their name and contact details for this purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consent may be withdrawn at any time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">14. Data of Minor Patients<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">When providing services to a minor, we take into account the child&#8217;s age, capacity to make decisions, the nature of the specific service, and the rights of the parent or other legal representative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We disclose a patient&#8217;s data to a representative only where and to the extent that the representative has the right to represent the patient and receive the relevant information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where necessary, we verify the representative&#8217;s authority before disclosing data.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">15. Your Rights<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Under the GDPR and other applicable legislation, you have the right to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>receive information about how your personal data are processed;<\/li>\n\n\n\n<li>ask what personal data SELUS Kliinik processes about you;<\/li>\n\n\n\n<li>obtain a copy of your personal data;<\/li>\n\n\n\n<li>request the correction of inaccurate or incomplete data;<\/li>\n\n\n\n<li>request the deletion of data where provided for by law;<\/li>\n\n\n\n<li>request restriction of processing where provided for by law;<\/li>\n\n\n\n<li>object to processing based on legitimate interests;<\/li>\n\n\n\n<li>where processing is based on consent, withdraw your consent at any time;<\/li>\n\n\n\n<li>exercise the right to data portability where provided for by law;<\/li>\n\n\n\n<li>lodge a complaint with the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon) or take legal action.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Not all data protection rights are absolute in the context of healthcare services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, SELUS Kliinik cannot delete healthcare records at a patient&#8217;s request where the clinic is legally required to retain them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When submitting a request, we may ask you to verify your identity in order to prevent the disclosure of patient data to an unauthorised person.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">16. Your Health Data and the Health Portal<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Patients can access their health data recorded in the national health information system through the <strong>Terviseportaal (Health Portal)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They can also review available logs concerning access to and use of their health data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where provided for by applicable law, patients may restrict access to their data stored in the national health information system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When restricting access, it should be taken into account that this may affect a healthcare professional&#8217;s ability to obtain a complete overview of the patient&#8217;s previous treatment and health status.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">17. Automated Decision-Making and Artificial Intelligence<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">SELUS Kliinik does not make decisions concerning a patient&#8217;s treatment, diagnosis or other significant matters based solely on automated data processing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clinical decisions concerning a patient&#8217;s health are made by appropriately qualified professionals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SELUS Kliinik does not automatically record or transcribe patient appointments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If SELUS Kliinik introduces technology in the future that materially changes the processing of patients&#8217; personal or health data, this Privacy Policy will be updated accordingly and, where necessary, patients will be informed before the new processing method is introduced.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">18.
